Terms of Service
These terms are an agreement between Douglas Anthony Silkstone, trading as Benson ("Benson", "we", "us"), of Nademlejnská 600/1, 198 00 Prague – Hloubětín, Czech Republic (IČO 10911243, VAT CZ8803201550), and the business that creates a Benson account ("you"). By creating an account, installing the Shopify app, or adding the Benson script to a website, you agree to them on behalf of that business.
The service#
Benson is software for online stores. It detects coupon, cashback and similar browser extensions on your storefront, measures how sessions with those extensions behave, can hide extension pop-ups on your storefront by rules you set, can apply a code policy in Shopify checkout for sessions where an extension is present, and can show your own discount widget to shoppers. Features depend on your plan (see Pricing).
Some features are marked early access or coming soon. Early-access features may change or be withdrawn, and are provided without the service commitments below.
Benson works on the pages where its script runs. On Shopify, no app can change what a browser extension shows inside Shopify checkout, and we don't claim to.
Your account#
- You must give accurate details and keep your sign-in secure. You're responsible for what happens under your account and for the people you invite to your workspace.
- Workspace owners and admins control members, sites and billing. Removing a member ends their access.
- You must be a business, not a consumer, and able to enter into this agreement.
Acceptable use#
You won't use Benson to:
- break any law, including consumer protection, privacy and electronic communications laws;
- install it on a website you don't own or aren't authorised to change;
- collect personal data through Benson beyond what the service is designed to handle, or send it names, emails or other identifiers in custom fields;
- probe, overload or interfere with the service, or get around plan limits, rate limits or security controls;
- copy, resell or reverse engineer the service, except where the law allows it.
We may suspend a site or account that puts the service or other customers at risk. We'll tell you why unless we're legally prevented.
Fees and billing#
- Plans, prices, session quotas and trials are set out on Pricing and in your billing settings. Prices exclude VAT and other taxes, which we add where required.
- Card payments are handled by Stripe. Paid plans renew each billing period until cancelled. A trial may carry a one-off fee, shown before you start.
- If you reach your session quota, Benson keeps working for a grace period, then pauses blocking and the widget until the next period or an upgrade. Detection continues on a sample.
- Fees already paid aren't refundable, except where the law requires or we say otherwise in writing.
Shopify billing#
If you install Benson through the Shopify App Store, you're billed through Shopify's billing system in the currency Shopify uses, and Shopify's terms for app charges also apply. Uninstalling the app ends the Shopify charge. We don't bill you twice for the same period.
Your data#
- Your data means the information you and your storefronts send to Benson: account details, workspace settings, discount codes, storefront events and order data.
- You own your data. You give us the right to use it to provide, secure and improve the service, and to produce aggregated statistics that don't identify you, your shoppers or your store.
- For storefront and order data about your shoppers, you're the controller and we're your processor. The Data Processing Agreement forms part of these terms.
- You're responsible for having a lawful basis for the measurement Benson does on your store, and for your cookie banner and privacy notice. Benson's consent settings help you respect your shoppers' choices.
- You can export your data and delete your workspace from your settings at any time.
Intellectual property#
We own Benson, including the software, signatures, documentation and brand. You get a non-exclusive, non-transferable right to use it during your subscription. If you send us feedback, we can use it without obligation to you.
Warranties#
We'll provide the service with reasonable skill and care. Detection is signature-based and extensions change; we don't promise to detect or hide every extension, or that a particular revenue or margin outcome will follow. Apart from what these terms say, the service is provided "as is", to the extent the law allows.
Liability#
- Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't be limited by law.
- Neither of us is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data, however it arises.
- Our total liability in any 12 months is limited to the fees you paid us in those 12 months.
Termination#
- You can cancel at any time. Paid plans end at the end of the paid period.
- We can end this agreement with 30 days' notice, or straight away if you materially breach it and don't fix the breach within 14 days of notice.
- When it ends, your access stops. We delete your data as described in the Privacy Policy and the DPA, after giving you the chance to export it.
Changes#
We may update these terms. For material changes we'll tell you in the app and by email, and ask you to accept the new version before you carry on using Benson. The version date is at the top of this page.
Governing law#
These terms are governed by the law of the Czech Republic, and the courts of the Czech Republic have exclusive jurisdiction.
Security#
We protect the service with encryption in transit and at rest for sensitive fields, least-privilege access, audit logging and regular reviews. If you think you've found a vulnerability, email [email protected]. Please give us reasonable time to fix it before disclosing it, and don't access other customers' data or disrupt the service while testing. We won't take action against good-faith research that follows these rules.
